Terms of Service

The legal agreement between you and GroomIQ when using our app.

1. Acceptance of Terms

By accessing or using the GroomIQ mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and GroomIQ ("we," "us," or "our"). We reserve the right to update these Terms at any time. Your continued use of the App after changes constitutes acceptance of the new Terms.

2. Subscription Terms

Apple App Store Subscriptions

  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings after purchase.

2.1 Subscription Plans

GroomIQ offers the following subscription options:

  • Free Plan: Limited features, including basic grooming analysis.
  • Premium Monthly: Full access to all features, billed monthly.
  • Premium Annual: Full access to all features, billed annually at a discounted rate.

2.2 Free Trials

We may offer free trials for premium subscriptions. If you do not cancel before the trial ends, you will be charged for the subscription at the then-current rate. Free trials are available once per user.

2.3 Cancellation & Refunds

You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellations take effect at the end of the current billing period.

GroomIQ is NOT a substitute for professional veterinary care. The AI-generated grooming instructions provided by the App are for informational and educational purposes only. They do not constitute veterinary advice, diagnosis, or treatment.

You acknowledge and agree that:

  • AI analysis may not be accurate in all cases.
  • You should always consult a licensed veterinarian for medical concerns.
  • You should consult a professional groomer for specialized grooming needs.
  • We are not responsible for any injury, illness, or damage resulting from following AI-generated instructions.
  • You use the App at your own risk.

4. User Conduct

You agree to use the App in a lawful and respectful manner. You will NOT:

  • Upload offensive, abusive, or inappropriate content.
  • Impersonate another person or entity.
  • Attempt to reverse-engineer, hack, or circumvent App security.
  • Use the App for commercial purposes without our written consent.
  • Share your account credentials with others.
  • Violate any applicable laws or regulations.

5. Intellectual Property

5.1 Your Content

You retain ownership of all photos and content you upload to the App. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Process your photos through our AI analysis system.
  • Store your content on our secure servers.
  • Use anonymized, aggregated data to improve our AI models (your photos will never be shared publicly or used for marketing without your consent).

5.2 Our Content

The App, including its code, design, text, graphics, and AI-generated content, is owned by GroomIQ and protected by intellectual property laws. You may not copy, modify, or distribute App content without permission, use our trademarks without consent, or scrape data using automated tools.

6. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent behavior, non-payment, or legal requirements.

Upon termination, your access will cease immediately, and you will not be entitled to a refund for unused subscription time. You may also terminate your account at any time via our Account Deletion Instructions.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
  • WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE.
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRIOR TO THE CLAIM.

8. Indemnification

You agree to indemnify and hold harmless GroomIQ from any claims, damages, losses, or expenses arising from your use of the App, your violation of these Terms, your violation of third-party rights, or content you upload.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of [STATE], United States, without regard to conflict of law principles.

Any disputes arising from these Terms or the App shall be resolved through:

  1. Informal Negotiation: Contact us at support@syndiscore.ai to resolve the issue.
  2. Arbitration: If informal negotiation fails, disputes will be resolved through binding arbitration in [STATE], per the American Arbitration Association rules.
  3. No Class Actions: You agree to resolve disputes on an individual basis and waive the right to participate in class action lawsuits.

10. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

11. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GroomIQ regarding the App and supersede all prior agreements.
